Last updated: [date to be added upon publication]
This document is a first draft prepared based on the platform's functional operation. It is not a substitute for legal advice — have it reviewed by a lawyer before publication, particularly regarding limitation of liability, notice periods and applicable consumer law.
1. Who we are
These terms and conditions ("Terms") apply to any use of FluxSuite, a product of Busselot BV (company number BE 1020.677.748, Ballingsstraat 13, 1570 Pajottegem, Belgium), hereinafter "we", "us" or "FluxSuite".
2. Acceptance
By creating an account on FluxSuite you accept these Terms. If you create an account on behalf of an organization, you declare that you are authorized to do so and you bind that organization to these Terms.
3. The service
FluxSuite is an online CRM platform (Software-as-a-Service) for customer management, quotes, invoicing and related business processes. The service is offered through a free basic plan with limited volume, and a paid "Basic" subscription with unlimited use, complemented by optional, separately billed modules. The current offering and its terms are available on our pricing page.
4. Account and use
- You are responsible for the confidentiality of your login credentials and for all activity that takes place through your account.
- You are responsible for the accuracy of the data you enter into the platform, including invoicing data and VAT information of your own customers.
- You may not use the platform for unlawful purposes or in a way that disrupts the service for other users.
- Each organization is responsible for managing its own users and their access rights within the platform.
5. Subscriptions and payment
- Paid subscriptions and modules are billed per period (monthly), in euros, through our payment partner (Mollie).
- Prices are shown excluding VAT, unless otherwise stated.
- An upgrade from the free to a paid plan takes effect immediately. A downgrade takes effect from the next billing period.
- In the event of late payment, we reserve the right to suspend access to paid functionality, following prior notice.
- More details about billing and payment terms can be found in our payment terms.
6. Cancellation
- You can cancel your subscription at any time via your account settings. Periods already billed are not refunded, unless legally required.
- We reserve the right to suspend or terminate an account in the event of a serious or repeated breach of these Terms.
- Upon termination of your account, you may request an export of your data within a reasonable period via info@fluxsuite.be.
7. Availability and changes
We strive for high availability of the platform, but do not guarantee uninterrupted or error-free operation. We may change, extend or adapt the platform's functionality from time to time. Material changes that limit paid functionality will be communicated in advance.
8. Liability
FluxSuite is provided "as is". To the extent permitted by law, our liability is limited to the amount you have paid us in the preceding twelve months. We are not liable for indirect damages, consequential damages or loss of profit. This limitation does not apply to damage caused by intent or gross negligence.
9. Your responsibility as a user
FluxSuite is a tool for administration and invoicing. The accuracy of your invoices, VAT application and compliance with tax obligations (including the PEPPOL obligation for B2B invoicing) remains your own responsibility as a user of the platform.
10. Applicable law
These Terms are governed by Belgian law. Disputes will be submitted to the competent courts of the judicial district where Busselot BV is established.
11. Contact
